New Trans Fat Regulation for the City of Lynn

The Lynn Board of Health passed a regulation restricting foods containing artificial trans fat in all food service establishments that are required to hold a permit from Lynn Board of Health as of January 1, 2012. These include restaurants, grocery stores, delis, cafeterias in schools and businesses, bakeries, caterers,
mobile food vendors, and other establishments.

After January 1, 2012, if a product contains more than .5 grams of trans fats per serving, then this product should not be used. For more information about trans fat and/or assistance in how to eliminate them in your establishment contact the Public Health Division of Lynn ISD for additional information and assistance.

A REGULATION TO RESTRICT FOODS CONTAINING
ARTIFICIAL TRANS FAT IN THE CITY OF LYNN


WHEREAS, heart disease is a leading cause of death in the United States;

WHEREAS, research concludes that there is no safe level of artificial trans fat consumption and there is a clear association between an increase in the intake of trans fat and the risk of heart disease;

WHEREAS, the major source of artificial trans fat is found in partially hydrogenated vegetable oil, which is used for frying and baking and is present in many processed foods;

WHEREAS, there are food service establishments and other food vendors in the
City of Lynn that prepare and serve food containing artificial trans fat for consumption by Lynn residents, visitors and students;

NOW THEREFORE, the Lynn Board of Health enacts the following regulation in furtherance of its mission to protect, promote and preserve the health and well-being of the citizens of Lynn.

Section 1.00:  Authority: M.G.L. c. 111, §31.
This regulation is promulgated pursuant to the authority granted to the City of Lynn board of Health by Massachusetts General Laws Chapter 111, Section 31 the “Boards of Health may make reasonable health regulations.”

Section 2.00:   Definitions
Artificial trans fat means food or beverage that is labeled as, lists as an ingredient, contains or is prepared with vegetable shortening, margarine or any kind of partially hydrogenated vegetable oil. However, a food or beverage whose nutrition facts label or other suitable documentation lists the trans fat content of the food as less than 0.5 grams per serving shall not be deemed to contain artificial trans fat.

Food service establishment means any entity that stores, prepares, packages,
serves, sells or otherwise provides food or beverage for consumption in the City of Lynn. Food service establishment includes, but shall not be limited to, restaurants, supermarkets, grocery stores, delis, sandwich shops, bakeries, convenience stores, ice cream shops, coffee shops, cafeterias in schools and businesses, caterers, senior-center meal programs, nursing homes, children’s institutions, school kitchens, school stores, soup kitchens and permanent or temporary concession stands. Food service establishment shall not include a fraternal, charitable, social, service club or similar organization that prepares, displays and sells home-made baked goods for a “neighborhood bake sale” so called.
Entity means any single individual, group of individuals, corporation, partnership, hospital, academic institution, society, association, firm, sole proprietorship or any other legal entity whether public or private.
Vending machine means any machine or device designated for or used for the vending of food products or beverages upon the insertion of coins, currency, swipe cards, or any other form of payment.
Mobile food vendor means any person or operation that sells food or beverage from a mobile food unit. A mobile food vendor shall include, but not be limited to, sidewalk vendors, canteen trucks, and food trailers.

Section 3.00 Restriction on Artificial Trans Fat
No food service establishment, vending machine, or mobile food vendor shall store, prepare, distribute, hold for service or serve any food or beverage containing artificial trans fat in the City of Lynn.
These prohibitions shall not include the sale of any food or beverage containing artificial trans fat that is in a manufacturer’s original sealed package and is required by federal and or state law to have nutrition labeling.

Section 4.00 Labels Required
All food service establishments, mobile food vendors and operators of vending machines shall maintain on-site original labels or other suitable documentation listing the ingredient and nutrient content of all food products such that the Lynn Board of Health or its designees can determine whether they are in compliance with this regulation.

Section 5.00 Guidelines
The Director of the Lynn Health Division of Inspectional Services shall issue guidelines for the implementation of this regulation, including but not limited to, definitions of terms as used in these regulations and in the guidelines. In the event of a conflict between these regulations and the guidelines, as either may be amended, the regulation shall control.

Section 6.00 Violations
1. A violator of this regulation may receive:
a. In the case of a first violation a warning will be issued.
b. In the case of a second violation within 24 months of the first violation a fine of two hundred dollars ($250.00); and,
c. In the case of a three or more violations within 24 months of the second or current violation, a fine of three hundred dollars ($300.00)
for each violation.
2. Each calendar day an entity operates in violation of any provision of this regulation shall be deemed a separate violation.
3. No provision, clause or sentence of this section of this regulation shall be interpreted as prohibiting the Lynn Board of Health or a City of Lynn department or agency from suspending, or revoking any license or permit issued by and within the jurisdiction of such departments or agency for repeated violations of this regulation.

Section 7.00 Enforcement
1. Authority to enforce this regulation shall be held by the Lynn Board of Health,
its subsidiary programs or designees; and the City of Lynn Inspectional Services Department.
2. Any violation of this regulation may be enforced in the manner provided in M.G.L. c.111 §187, by the Lynn Board of Health, its subsidiary programs or designees.

Section 8.00 Severability
If any provision, clause, sentence, paragraph or word of this regulation or the application thereof to any person, entity or circumstances shall be held invalid, such invalidity shall not affect the other provisions of this article which can be given effect without the invalid provisions or application and to this end the provisions of this regulation are declared severable.

Section 9.00 Effective Date
This regulation shall take effect on January 1, 2012 with respect to cooking oils, shortening, and margarines containing artificial trans fat and with respect to baked goods and all other foods containing artificial trans fat.

What You Should Know About Bed Bugs

A recent nationwide increase in infestations concerning bed bugs has resulted in a need for this notice concerning how to deal with bed bugs. It outlines preventative measures that may assist in helping to control this unfortunate situation and also lists several facts and circumstances that will help to educate residents on how to control this infestation problem.

FACTS
:

  • Bed bug infestation has nothing to do with one’s housekeeping. Spotless homes many times are subjected to infestation as well as units in need of cleaning.
  • Generally cluttered conditions make for safe havens for bed bugs and make the extermination process extremely difficult.
  • Existing extermination methods are very time consuming and are often times required to be done several times to eliminate the problem.
  • Extreme infestations can result in a need of the tenant to discard furnishings, beds, box springs, and in isolated instances residents are required to get rid of all of their belongings (TVs, phones, etc.).
  • Bed bugs hide in bedding, carpets and baseboards, in the folds of curtains and drapes, inside and underneath drawers, and behind loose wallpaper.
  • Generally, clothing can be saved by washing in HOT temperatures. Persons must take great care in the transporting of infested clothing to washing facilities in order to not spread the problem. Double, tightly sealed, plastic bags are recommended for assisting in transportation of infested clothing.
  • Dead bed bugs are capable of hatching new babies. Therefore, vacuuming any dead bedbugs after any extermination process is a MUST! It is suggested the bag type vacuums that allow for careful disposal of the bag again in double, tightly sealed plastic bags is the way to go.
  • Consistent vacuuming of carpets and furniture is a good preventative measure. Again please practice proper disposal techniques that are previously outlined above. 
  • BED BUGS are a tough critter to exterminate. Often times, repetitive treatments are necessary.

Heat Wave Cooling Stations (July 2011)

Mayor Kennedy Announces Availability of Cooling Stations
Lynn Tech Annex and Lynn Senior Center
Extended Hours For Thursday, July 21st and Friday, July 22nd

Mayor Judith Flanagan Kennedy reminds residents to prepare for the hot and humid weather by taking precautions to reduce heat related problems especially the elderly, the very young and people with respiratory illnesses.

In order to get relief from the heat the first floor of the Lynn Tech Annex on 90 Commercial Street will be available on both Thursday and Friday from 1 PM until 8 PM. So pack a picnic, bring a deck of cards, the kid’s favorite games or board games and relax in air conditioning. 

The Lynn Senior Center on 8 Silsbee Street will also be open
from 8 AM until 7 PM on both Thursday and Friday. 


Please limit activities during very hot weather. Also, drink plenty of water regularly and often even if you don’t feel thirsty. Avoid beverages that contain caffeine or alcohol. Additional measures to beat the heat include taking cool showers or baths, and wearing loose, light-colored clothing. Avoid cooking and eat well-balanced, light, regular meals. If you do not have air conditioning, stay on your lowest floor, out of sun. Electric fans do not cool the air, but they do evaporate perspiration, which cools your body.  Never leave children or pets alone in a closed vehicle. Please check on family, friends and neighbors.

Heat Stroke is the most serious heat-related illness. When the body is unable to control its temperature, the temperature rises rapidly and the body is unable to sweat and cool down. This can occur rapidly, within 10 -15 minutes, with body temperature rising to 106 degrees F.

The Warning Signs of Heat Stroke Include:

An Extremely High Body Temperature (Above 103 Degrees F)
Red, Hot, Dry Skin ( No Sweating)
Rapid, Strong Pulse
Throbbing Headache
Dizziness
Nausea
Confusion or Disorientation

Heat Exhaustion is a milder form of heat-related illness that can develop after several days of extreme heat and inadequate or unbalanced fluid intake.

The Warning Signs of Heat Exhaustion Include:

Heavy Sweating
Pallor
Muscle Cramps
Tiredness
Weakness
Dizziness
Headache
Nausea or Vomiting
Fainting
Cool, Moist Skin
Fast, Weak Pulse
Fast and Shallow Breathing
Confusion or Disorientation

If you believe you, or anyone you are with, is experiencing a heat-related medical emergency, promptly call 911, and if possible, move to a cooler place.

Jonathans Sprouts Inc.508-763-2577 (Extends Recall of 4/19/11 to Additional Products and Codes) Contact:  Liz Reilley 508-763-2577  April 22, 2011  Jonathans Sprouts of Rochester, MA is upgrading its recall of conventional alfalfa sprout products with a specific sell by date to include all of its alfalfa products, conventional and organic, with all sell-by dates, as a precaution, because it has the potential to be contaminated with Salmonella.

They are sold at the following stores: A&P, Grand Union, Stop & Shop, Shaws, Hannaford, Donnelans, Foodmaster, Truccis, Roche Brothers  Also, distributed in bulk to restaurants, foodservice, etc. The products containing alfalfa sprouts were distributed in Massachusetts as well as other Northeast states. Consumers who have purchased Jonathans Sprouts products containing alfalfa sprouts are urged to return it to the place of purchase for a full refund. Whole Cucumbers
Possible Salmonella

April 22, 2011  L M Companies, Inc. of Raleigh, NC is issuing a voluntary recall of one lot (1590 cartons) of whole cucumbers because it has the potential to be contaminated with Salmonella.

No illnesses have been reported in association with this recall, and no other products are involved.  L& M Companies is issuing a nationwide recall. The recalled bulk cartons are marked Natures Delight and contain the Lot # PL-RID-002990 on the side of the carton.

Only this one lot is being recalled.  Consumers who think they may have the recalled product in their possession should not consume it and should contact the place of purchase to determine if their cucumber is included in this recall. Consumers or customers with questions may call L& M Companies at 919-981-8003, Monday to Friday, 8:00 a.m. to 5:00 p.m. Eastern Standard Time.

 

Target Stores-Archer Farms Ground
Tumeric-Possible Lead

April 15, 2011

B and M, Inc. of Mount Vernon, Missouri is voluntarily recalling Archer Farms Ground Turmeric sold at Target stores in glass bottles with a net weight of 2.6 oz., due to elevated levels of lead. This voluntary recall is a result of notification from B&M, Incorporated s supplier that the Ground Turmeric they provided contained excessive levels of lead. The Archer Farms Ground Turmeric was distributed nationwide and in Massachusetts to Target retail stores from June, 2009, to February, 2010. No other Archer Farms Brand spices have been affected by this voluntary recall. No illnesses have been reported to date in connection with this
voluntary recall.

Consumers in possession of this voluntarily recalled product may return it to the store at which you purchased it. Consumers or media with questions should contact B&M, Inc. at 1-877-321-5852 or contact Target Guest Relations toll free at (800) 316-6151.

 

FRESH EXPRESS SPINACH RECALL

April 5, 2011 Salinas, CA 

Fresh Express is voluntarily recalling 2,939 cases of 9 oz. Bag Spinach with Product Codes starting with H081 and H082, UPC Code of 7127913204 and Use by Dates of April 6 and 7 out of an abundance of caution due to a positive result for Salmonella from random sample testing.

The company is not aware of any illnesses reported in connection with the recall and no other Fresh Express products are included in the recall.    Consumers who have purchased the product should not consume it, but rather discard it and contact their retailer for a full refund. Consumers with questions may call the Fresh Express Consumer Response Center at (800) 242-5472.            

Distribution:  Pennsylvania, New York, Maryland, Connecticut, Rhode Island, Massachusetts and Maine.       Possible Redistribution:  New Jersey, Virginia, Delaware, Vermont, New Hampshire, West Virginia Ohio and DC.

 

JENNIE-O-TURKEY RECALL: APRIL 4, 2011

WASHINGTON, April 1, 2011 -Jennie-O Turkey Store, a Willmar, Minn. establishment, is recalling approximately 54,960 pounds of frozen, raw turkey burger products that may be contaminated with Salmonella, the U.S. Department of Agriculture's Food Safety and Inspection Service (FSIS) announced today. As FSIS continues its investigation of illnesses related to this recall, additional raw turkey products may be recalled. As a result, FSIS is alerting consumers to take extra care when preparing all raw turkey products.

To prevent salmonellosis and other foodborne illnesses, wash hands with warm, soapy water for at least 20 seconds before and after handling raw meat and poultry, and cook poultry—including ground turkey burgers—to 165° F, as determined with a food thermometer.

4-pound boxes of Jennie-O Turkey Store® "All Natural Turkey Burgers with seasonings Lean White Meat". Each box contains 12 1/3-pound individually wrapped burgers.

A use by date of "DEC 23 2011" and an identifying lot code of "32710" through "32780" are inkjetted on the side panel of each box, just above the opening tear strip. Establishment number "P-7760" is located within the USDA mark of inspection on the front of each box. The products were packaged on Nov. 23, 2010 and were distributed to retail establishments nationwide.

MISLABELED FROZEN CHICKEN: March 31, 2011

Alabama Firm Recalls Frozen Chicken Fillet Products due to Mislabeling and an Undeclared Allergen

WASHINGTON, March 31, 2011 Wayne Farms, a Decatur, Ala., establishment is recalling approximately 53,210 pounds of frozen, breaded, fully cooked Italian-style chicken breast fillet products because they contain an undeclared allergen, egg, which is not noted on the label. Egg is a known allergen.  Individual packages bear the establishment number "P-33885" inside the USDA mark of inspection.

The product case label would also contain one of the following code numbers: B13464, 13464 or 20947 in large bold print. The products were produced between Aug. 3, 2010 and Nov. 13, 2010 and were shipped for foodservice use nationwide and to distribution centers in New Jersey and Massachusetts.

The problem was discovered March 29, 2011 by a company representative during a label review at the establishment, and may have occurred because of a label change at the establishment. FSIS and the company have received no reports of adverse reactions due to consumption of these products

 

BUBBLE GUM RECALL: March 28, 2011

RECALL-Toxic Waste Short Circuits Bubble Gum-possible lead

Candy Dynamics, Indianapolis, IN, is issuing a voluntary recall of Toxic Waste Short Circuits Bubble Gum.

The product is imported from Pakistan.   A recent test performed by the U.S. Food and Drug Administration has indicated that Lot #15070SC12 of the 3.2 oz. size of the above listed product contains elevated levels of lead.  

Out of abundance of caution, the company has determined to recall Lot #15070SC12, which was distributed from January 4, 2011 until March 18, 2011.

The recalled Short Circuits Bubble Gum product was distributed nationwide in retail stores and through mail orders. Candy Dynamics is sending recall notices to its direct customers. Anyone in possession of the recalled product should telephone the company for information on destruction of the product.

03-17-11 Update on Plastic Disks in the Merrimack River and Found Washing Up Along the Coast of Massachusetts and New Hampshire

Plastic Mesh Disks Tested by MassDEP Show Low or No Levels of Bacteria

As reported earlier this week in various news outlets, small white thin circular mesh disks that are approximately two inches in diameter were released into the Merrimack River from the Hooksett, NH Wastewater Treatment Facility on March 6, 2011 following heavy rainstorms. Hooksett officials say the affected wastewater treatment tank held over 39 million disks and that 10 to 20 percent of the disks may have been released to the Merrimack River or an estimated four million to eight million disks.

Disks are showing up all along the Merrimack River, on New Hampshire beaches and on Massachusetts beaches from Salisbury around the Rockport /Gloucester peninsula and into Beverly as of 3/17/11. There is a possibility that the disks may continue to migrate and show up on your city or town beaches, at marinas and boat ramps or in your rivers, marshes, creeks, etc.

Testing of the disks by the Massachusetts Department of Environmental Protection (MassDEP) show some bacteria, but at ranges that do not exceed levels of concern. Although the low levels of bacteria are typical of those present in any form of litter or debris that washes up on beaches, out of an abundance of caution, MassDEP and the Massachusetts Department of Public Health (MDPH) advise that the public should treat the disks like any litter and avoid contact with the disks unless taking proper precautions. If picking up or handling the disks, the public should wear protective plastic gloves and thoroughly wash their hands, and make sure not to put their fingers in their mouth, eat, drink or touch their eyes before washing their hands. Also, the public should be advised to not allow children to play with the disks, and to not allow pets such as dogs and cats to come in contact with the disks.

If municipal employees, volunteers of individuals wish to do some beach cleanup and there are disks present, normal “beach cleanup guidelines” should be followed. Gloves (such as latex gloves) should be worn to pick up any disks. No additional equipment or clothing is required. Disks and gloves should be bagged and disposed of in the trash for regular disposal as solid waste. When a person is done, hand gels may be used, but hand washing with soap and water for a minimum of 20 seconds is preferred. Clothing worn during cleanup work should be laundered as normal.

Due to high water during this time of year, MassDEP strongly discourages volunteers or municipal employees from attempting to clean up disks from along the banks of the Merrimack River. Professional contractors are currently conducting cleanups in those areas.

The Executive Office of Energy and Environmental Affairs (EEA) and its agencies, along with emergency management representatives from impacted coastal and Merrimack River communities, are coordinating disk cleanup efforts and working with the New Hampshire Department of Environmental Services on overall response. Additional updates will be provided to you by MEMA and EEA as soon as possible. Massachusetts Ban on Caffine Added Drinks

The Massachusetts Alcoholic Beverages Control Commission today, November 18, 2010, filed an emergency regulation prohibiting the sale of alcoholic beverages that contain caffeine as an added ingredient. The regulation goes into effect immediately.

This means that alcoholic beverages that contain caffeine as an added ingredient, including Four Loko, must be removed from store shelves in Massachusetts today. The regulation follows a ruling yesterday by the U.S. Food and Drug Administration that alcoholic drinks that contain added caffeine pose a public health risk.

Reminder Notice from the Board of Health
October 1, 2010 was the effective date of the new Food Allergy Awareness Regulation


In June 2010, the state Food Code was amended to comply with the Act Relative to Food Allergy Awareness in Restaurants which the Governor signed into law in January 2009. Copies of the new regulation and related documents are available on the MDPH/BEH Food Protection Program website. To find this information:

(2) Select “Food Allergen Awareness Regulation” link under “What’s New”
(3) See “Food Allergen Awareness Regulation” under “Special Operations”
These amendments to the Food Code became effective on October 1, 2010, and apply to all food establishments that cook, prepare, or serve food intended for immediate consumption either on or off the premises. In order to meet these new requirements, food establishments must: Display a copy of a poster in the employee work area, and
Place a notice to consumers on menus and menu boards.
Poster in Employee Work Area - The 8.5” by 11” poster that must be displayed in the employee work area is available on line at http://www.foodallergy.org/page/restaurant-poster. The “employee work area” is a conspicuous and accessible place where notices to employees are usually placed and easily read. See 105 CMR 590.009(G)(1) for more details about this requirement..
Notice to Consumers on Menus and Menu Boards - Menus and menu boards must include a notice which reads, “Before placing your order, please inform your server if a person in your party has a food allergy.” The notice must be displayed in a clear and conspicuous manner, and the notice on menu boards must meet the font size requirements discussed in 105 CMR 590.009(G)(2)(b).
Additional Requirements after February 1, 2011 – Certified food protection managers in effected establishments must obtain a certificate by 2/1/11 which shows that they have viewed the allergen awareness training video being developed by MDPH. Three vendors are approved by MDPH to issue these certificates in accordance with 105 CMR 590.009(G)(3)(a). The names of the vendors and their contact information will be posted on the FPP website listed above.

A collection box is located in the lobby of at the Lynn Police station for year round access. This program allows individuals to drop items for disposal into a secure container. Drop-offs can be performed 24 hours a day and are completely
confidential.

VISUAL MILE MARKERS ENCOURAGE GETTING PHYSICAL

Campaign to Increase Physical Activity and Overall Wellness among Area Residents Regular physical activity reduces the risk for many chronic diseases, helps to maintain a healthy weight, and strengthens muscles, bones, and joints. Diseases that may be avoided with regular physical activity are diabetes, heart disease, stroke, high blood pressure, depression, cancer, obesity, asthma and injuries related to falls.

In response to the rising rates of chronic diseases, the Healthy Lynn Partnership at the Health Division of the Inspectional Services Department launched a Walking and Jogging Project to increase physical activity among the residents of Lynn, Nahant and Swampscott.  Implemented by Health Intern Jenn Schumann, and with support from the Lynn Department of Public Works, and the Department of Conservation and Recreation the project includes ¼ mile marker medallions along Lynn Shore Drive covering approximately 3 miles. 

Dubbed The Nahant, Swampscott & Lynn Good Health Partnership, the markers extend along the beach front sidewalk area from The Tides restaurant (2B Wilson Road) to the Red Rock Bistro (141 Humphrey St) in Swampscott.  These visual markers encourage efforts made by those walking, running, or bicycling by informing residents how far they have gone.  In addition to the physical fitness benefits, the markers are proving to increase the overall use of this wonderful area. The partnership believes that overall wellness of the residents of Lynn can be improved through increased physical activity and healthy eating habits. A community-wide effort is needed to increase the health of residents through the support of these types of health initiatives.  The Nahant, Swampscott & Lynn Good Health Partnership aims to empower residents to take control of their health and to reach their own health “markers”
